Tahliba - under some schools' pastoral care a pupil remains under the school rules outside of the building if they are in uniform.
My nephew got suspended for wearing his hat (not allowed in school) on his way home because he was spotted by a teacher. If the child was in school uniform and smoking then they would have had every right to suspend him, and the mother can't possibly defend this as its against the law.
If they are running the school like a Ltd company then i see where they are going, if the child is not contributing towards the development of the school, and in fact actually creates problems by not sticking to the rules, like any employee they will get the 'sack'.
My eldest schools' rules are sometimes ridiculous, i.e girls and boys can't have lunch at the same time, you can only go up the stairs on the right of the building, to go down you have to use the stair case all the way on the other side of the school. Stupidness. The people running the school don't have a clue about people management. But he enjoys going there, and he brings home high high grades.
With the government run alternatives failing badly all over the country and discipline levels at an all time low, i think these academies are the best were going to get.
