Husband kills wife's lover; wife charged
POSTED: 6:45 p.m. EDT, March 30, 2007
• Caught with lover, wife cries rape; husband shoots fleeing man
• Grand jury charges woman with manslaughter
• Texas law exonerates those who believe actions are justified at time
• Wife also charged with making false report to police
Adjust font size:
ARLINGTON, Texas (AP) -- Darrell Roberson came home from a card game late one night to find his wife rolling around with another man in a pickup truck in the driveway.
Caught in the act with her lover, Tracy Denise Roberson -- thinking quickly, if not clearly -- cried rape, authorities say. Her husband pulled a gun and killed the other man with a shot to the head.
On Thursday, a grand jury handed up a manslaughter indictment -- against the wife, not the husband.
The grand jury declined to charge the husband with murder, the charge on which he was arrested by police.
"If I found somebody with my wife or with my kids in my house, there's no telling what I might do," said Juan Muniz, 33, who was having lunch Friday with one of his two small children at a restaurant in the middle-class suburban Dallas neighborhood where the Robersons lived. "I probably would have done the same thing."
Tracy Roberson, 35, could get two to 20 years in prison in the slaying of Devin LaSalle, a 32-year-old UPS employee.
Assistant District Attorney Sean Colston declined to comment on specifics of the case or the grand jury proceedings but said Texas law allows a defendant to claim justification if he has "a reasonable belief that his actions are necessary, even though what they believe at the time turns out not to be true."
Mark Osler, a Baylor University law school professor and a former federal prosecutor, said the grand jurors evidently put themselves in the husband's place: "I can see one of them saying, 'I would have shot the guy, too. I was just protecting my wife.' "
The December night before the shooting, Tracy Roberson sent LaSalle a text message that read in part, "Hi friend, come see me please! I need to feel your warm embrace!" according to court papers. LaSalle apparently agreed.
Darrell Roberson, a 38-year-old employee of a real estate firm, discovered the two, his wife clad in a robe and underwear.
When Tracy Roberson cried that she was being raped, LaSalle tried to drive away and her husband drew the gun he happened to be carrying and fired several shots at the truck, authorities said.
Darrell Roberson's attorney did not immediately return a call for comment.
His wife also was charged with making a false report to a police officer -- for allegedly saying she was raped -- and could get up to six months behind bars on that offense. It was not immediately clear whether she had a lawyer.
She had not been arrested as of Friday afternoon.

I think that the verdict is a bit harsh. I am very sorry that a man has lost his life over this though.

SS you I condemn adultry an all that but murder can't pass with me man. Cheating is bad but you don't deserve to die!
And I can't see her being charged because HE killed a man. That's bullshit justice. An adult is supposed to be responsible for their actions. The law can't excuse you because you were "provoked". That sets up all kinds of stupid precedents. I don't like that decision at all

Well he did think she was raping his wife. But surely he must of seen at least 5 seconds of their passion to evaluate for himself. Maybe she saw hisvehicle and already made up her mind what to say.
If he genuinely thought she was being raped/ then I can see how it was justified. Frankly though the brother derserved what was coming to him. Fool around with a mans wife is one thing.. but in her family drive..is he stupid! He might as well of put on the mans slippers.. sit in his favourite armchair and wait for him to come home while goading him. lol.

Are you aware of the fact she screamed rape...as MEN let that through your mind a few times...and then tell me with bloody honesty that you wouldn't have done liekwise..
Reminds of this other case when apedophil/rapist (yeah I know I should just say pedophil)had broken into a house and raped a young girl. Daddy found out, throw the man out on the street and killed him with an axe. Daddy got 4 years for that (meaning he was absent from his daughter who had just gone through hell in 4 years, likely the most important 4 years). What's my point ? When something happen men will act without thinking, as this man did with man who raped his daughter. If he had thought it through maybe he would have wounded they guy and called the cops or so, and thus likely not going to jail...
I saw the brothers face (darrell) poor guy...the woman had poor judgment, I feel a bit of pity for her as well, but at the same time. She not onyl cheated, she lacked the balls to take responsibility for it (pun intended)

The acticle doesn't quite tell the whole story. The brother came home alittle earlier from a poker game and saw his wife in the driveway embraced with a man.
When he walked up on them, she told him she was being raped by the guy. The guy he shot was talking sh*t to him and tried to punk him and drive off. He threatened her husband and that's when he got shot.
I'm not saying it was right, but that was his side of the story and witnessesthat were on the news that night said that's what they saw. I don't believe she will do very much jail time if any. She may get 5 years maximum.
Since it's a Grand Jury that is actually in her favor. They arefrequent jurors who tend to be a bit less emotionally invovled than your typical jury. They are chosen by the judge instead of lawyers. As of Monday they still hadn't arrested her according to news reports.
