Thank you for your email sent on 15th July 2007. I am writing in response to this email which you asked to be treated as a Freedom of Information request.
You asked if there has been a Race Equality Impact Assessment for the Forward Plan item FR 09.02.07. This item is the June 2007 Overall Financial Position report to Cabinet in September. The Overall Financial Position report is a monthly report to the Cabinet which tracks the spend to budget position of Council directorates relating to both revenue and capital expenditure. It is purely a tracking report and as such does not require an EIA.
In your email you asked 5 additional questions to the one above, below are responses to these questions.
1. Are any of the Hackney Finance and Corporate Resources departments Institutionally Racist which is the same as White Supremacist?
All Hackney staff members are asked to agree to and sign the Council’s Code of Conduct at the start of their employment. This Code of Conduct specifies that staff must ‘Never use your work to further the aims of any group whose ideas are in conflict with Council policy (e.g., a fascist organisation)’.
In addition, all departments are committed to the Council’s Equality and Diversity Policy and equality related plans, such as the Race Equality Scheme. Each Directorate has a Diversity Equality Implementation Group, which monitors their departments’ progress against equality related objectives and helps mainstream equalities throughout all our services.
2. How many of the Hackney Finance and Corporate Resources departments have the correct number of Black and Minority Ethnic staff in Executive, Directorship and Senior Management positions?
As part of the Best Value process, all Local Authorities must report on the percentage of Black and Minority Ethnic staff who are in the Top 5% of earners on an annual basis. Our latest figures show that just over 30% of our Top 5% of earners are from BME communities. The BME population for Hackney as a borough is approximately 40%. Whilst our figure is slightly lower than the Borough’s population, our performance is in the Top 25% of all London Borough. The attached spreadsheet gives more information on the breakdown of the staff in the Council.
3. What checks are in place to ensure that staff in the Hackney Finance and Corporate Resources departments are not members of Racist organisations?
As stated in response to question 1, all staff must agree to by signing the Code of Conduct at the start of their employment. The code of conduct is specific in that staff should do nothing away from work which might damage public confidence in the Council or make them unsuitable for the work they do. If a member of staff behaviour breaches the Council’s Code of Conduct they would be subject to disciplinary procedures and their continued employment with the Council would be at risk.
All senior members of staff must also complete and sign a Declaration of Interest form. In addition, some posts require a Criminal Record Bureau check before starting.
4. Please would you send me by post and email the latest performance results of the Hackney Finance and Corporate Resources department Race Equality/Diversity Scheme that show how it is monitored, managed and evaluated with information about the distribution of Black and Minority Ethnic people in comparison to White people at all levels of management.

This autumn the Council will be consulting with local BME organisations on revised targets, which will be finalised in March 2008.
As indicated in question 2, approximately 30% of our Top 5% of earners are from BME communities compared to 40% in the Borough. Overall, BME staff make up approximately 41% of our workforce. I will ensure that you receive a copy in the post as well.
5. Would you please send me the Hackney Finance and Corporate Resources Organisational Chart (management structure) including job titles and ethnicity. Please apply the Freedom of Information Act where and if necessary.

It is not possible to provide details of the ethnic origin of individual managers as that would breach the Council’s responsibilities under the Data Protection Act.
