Thank you for your letter dated 20 June 2007 in reply to my email.



To the question number one (1) and I quote:

"Are any of the Royal Courts of Justice departments Institutionally Racist which is the same as White Supremacist?"


You answered on behalf of the Royal Courts of Justice and I quote:


"No."


This is a very definative and absolute answer on behalf of the Royal Courts of Justice.


Please would you share with me the evidence that you have seen that has enabled you of behalf of the Royal Courts of Justice to answer "No" to that question.



It is often reported that people classified as Black are over represented as criminals in the Justice System and therefore it would be foolhardy and stupid for any person classified as Black to accept information from White people in the Justice System without asking for the relevant proof as necessary.

Thank you for the information about job titles in answer to question number two (2) about the correct representation of Black and Minority Ethnic people in Senior Management positions at the Royal Courts of Justice.


You said and I quote:

Please would you send me a copy of the Royal Courts of Justice organisational chart (Management Structure) with details of the Ethnicity of each member of staff and job title. Please apply the Freedom of Information Act as necessary in the processing of this information.



The reason for this request is that an Institutionally Racist which is the same as a White Supremacist organisational structure cannot make balanced judgements about the ability and competence of Black and non-white people for the job because all decisions would be Racially biased consciously or unconsciously. That is what a Race Equality / Diversity Scheme, that is managed properly, can help to highlight.

I am very pleased to hear that the Royal Courts of Justice has, and I quote:


"an Equality and Diversity Policy, which promotes a zero tolerance to any form of discriminatory behaviour in our working culture or practices."


It is obvious that having an Equality and Diversity Policy is no evidence that anyone is adhereing to it. I hope that the information you have sent will have details of how the impact of the Equality and Diversity Policy is being monitored and the results of this monitoring. If not please would you forward that information as soon as possible.

What is being done to address the current dangerous and unbalanced situation for Black and non-white people in the short term?


Institutional Racism which is White Supremacy is having a huge impact on the lives of Black and Minority Ethnic people daily. Many thousands of people will continue to suffer unjust and unbalanced treatment each and every day until such time as the problem of Institutional Racism is solved.

Limitations of an organizational chart
There are several limitations with organizational charts:

It only shows 'formal relationships' and tells nothing of the pattern of human (social) relationships which develop.
It shows nothing about the managerial style adopted (e.g. autocratic or democratic)
It very quickly becomes out-of-date, especially in large organizations which change their staff regularly.

Example of an organizational chart
The following is an example of a simple hierarchical organizational chart:




An example of a line relationship in this chart would be between the general and the two colonels. These two colonels are directly responsible to the general.

An example of a lateral relationship in this chart would be between "Sergeant A", and "Sergeant B" who both work on the same hierarchical level and both report to the "Captain A".


Drawing organizational charts
There are a number of software products that can be used to create organizational charts. Microsoft Visio and PowerPoint are common tools. There are also dedicated organizational charting products created by Aquire, HumanConcepts and Cezanne Software that allow companies to create organizational charts by connecting to SAP, PeopleSoft and Oracle ERP systems.

I can see from communications from colleagues that you have already received responses to a number of enquiries you have made. I
have supplied you with a copy of our action plan which shows what is being done to address our duties under the current Race Equality Scheme. As you can see it provides a breakdown of the ethnicity of staff who work in the Royal Courts of Justice

I would like to re iterate the point made by Mr Anderson that it is our responsibility to show what we are doing to comply with the Race Relations (Amendment) Act 2000. This Act requires all public organisations to produce a Race Equality Scheme that shows how they will take action to comply with the general duties. A Race Equality Scheme was issued and published in 2002. This document was reviewed, and refreshed in 2006. Seeing that you spent the trouble to send me the plan, which effort I do appreciate, I will raise a few questions and comments based on the information you have provided.


1. What is the current distribution of Black and Minority Ethnic staff throughout The Royal Courts of Justice compared to White staff and how will this impact on efforts to achieve the future Action Plan?


2. What evidence is there that previous Action Plans in The Royal Courts of Justice have been successful and how were those Actions Plans evaluated?


3. Please would you send me copies of all the Action Plans and the results of these plans in The Royal Courts of Justice since 2002 to date.


4. How has the 'SMART' rule been executed since 2002 to date and how has it impacted on the distribution of Black and Minority Ethnic people in The Royal Courts of Justice in comparison to White people?


5. What has been done to involve the Black and Minority Ethnic community in the Justice system since 2002 to date and what were and are the current results?


6. Please send me copies of all the Race Equality Impact Assessments carried in The Royal Courts of Justice out since 2002 to date.


7. Are there any and have there ever been any Black managers available to process the Race Equality Impact Assessments in The Royal Courts of Justice since 2002 to date?


8. What local monitoring by ethnicity in The Royal Courts of Justice has taken place since 2002 to date?


9. Which organisations have been used to run the Diversity Awareness Training courses since 2002 to date? How was the effectiveness of these organisations evaluated in The Royal Courts of Justice?


10. Has there been any records of the vetting of organisations claiming to offer Diversity Awareness Training courses to The Royal Courts of Justice since 2002 to date? Did these organisations have successful Race Equality Schemes themselves?
